In the brief, filed with a three- judge federal court scheduled to hear oral arguments on the issue Friday, the department said it was taking that position because the congressmen could not demonstrate that they have yet been injured by passage of the act. The group of congressmen, led by Rep. Mike Synar, maintain in their suit that portions of the Gramm-Rudman Act would unconstituionally infringe on their powers.

Earlier Wednesday, an official of a union representing retired employees of the Customs Service and the IRS said that spending cuts required by the new law could backfire and "devastate this nation's ability to raise revenue. President Reagan signed the Gramm-Rudman Act on Dec. 12. At the time, however, he expressed reservations about the constitutionality of a provision in the law that empowers the comptroller general to make a finding of the amount of budget cuts needed to make deficit-controlling targets, and write an order that Reagan would be required to impose. The administration maintained in its brief that the comptroller general, as an officer of the Congress, lacks constitutional authority to compel presidential action, and that only members of Congress themselves can do that through passing legislation or overriding presidential vetoes.

It argued that such authority could only be conferred on an officer of the United States who is in the executive branch and serves at the pleasure of the president. Robert M. Tobias, president of the National Treasury Employee's Union, told a news conference that the first round of cuts under the Gramm- act. expected March 1, would force personnel and other cutbacks in the agencies that would translate into $3 billion in lost revenues this year. This figure would swell to a total of $32 billion over the next five years.

Guirnalda was employed as a manager trainee for the clerical staff at the Holiday Sands Hotel in the Norfolk, area. JOSEPH M. SULLIVAN, JR. ORONO Joseph M. Sullivan, 63, husband of Patricia Judkins Sullivan, died Jan. 7, 1986, at the VA center at Togus after a long illness.

He was born in Greenville, Feb. 22, 1922, the son of Joseph M. and Alice (Harrington) Sullivan, Sr. Mr. Sullivan had been a herdsman on the Rex Varnum farms and most recently at Grant's Dairy Farm.

He was World War 11 Army veteran serving in the European theatre with the army in fantry. He was member of the VFW Post No. 832 of South Portland, John F. Kennedy Post No. 6, DAV, of Bangor and the American Legion of Orono.

He is survived by his wife of Orono: two sons, Sgt. Joseph M. He had resided in Washington state for more than 40 years, where he was self-employed in the logging and trucking industry.
